The real estate industry has embraced AI with remarkable speed. Agents use it to write property listings, generate market analyses, draft client emails, and even create marketing materials. Brokerages are integrating AI into CRM systems, lead scoring, and transaction management. The productivity gains are real — but so are the risks that come with ungoverned AI adoption.
The first risk is data privacy. Real estate transactions involve some of the most sensitive personal information people will ever share — financial records, identification documents, employment details, and family circumstances. When agents paste client information into AI tools like ChatGPT to draft offer summaries or client communications, that data may be stored, logged, or used for model training. Most agents don't realize this, and most brokerages haven't told them not to do it.
The second risk is AI hallucinations in property information. AI tools can generate convincing but entirely fabricated details — incorrect square footage, nonexistent features, wrong zoning classifications, or inaccurate neighbourhood statistics. When these errors appear in listings or client communications, they create legal liability. A buyer who relies on AI-generated property information that turns out to be false has grounds for a complaint — and the brokerage is responsible.
The third risk involves fair housing and bias. AI systems trained on historical data can perpetuate discriminatory patterns in property recommendations, pricing suggestions, and neighbourhood descriptions. If an AI tool steers clients toward or away from certain areas based on demographic patterns embedded in its training data, the brokerage faces serious human rights and regulatory exposure — even if no one intended the outcome.
The fourth risk is brand and reputation damage. When AI-generated content goes out under your brokerage's name without human review, you're trusting a machine to represent your brand accurately. One AI-generated email with incorrect information, an inappropriate tone, or a fabricated claim can damage client relationships that took years to build. In an industry built on trust, this risk is existential.
The fifth risk is regulatory compliance. Real estate is one of the most heavily regulated industries in Canada. Provincial regulators, FINTRAC, privacy commissioners, and real estate boards all have expectations about how client information is handled and how services are delivered. AI usage that doesn't comply with these frameworks creates compliance gaps that regulators are increasingly equipped to identify and penalize.
The solution isn't to ban AI — it's to govern it. Brokerages need clear acceptable use policies, data handling guidelines that specifically address AI tools, mandatory human review processes for AI-generated content, staff training on AI capabilities and limitations, and documented governance frameworks that demonstrate due diligence. The brokerages that implement these frameworks now will have a competitive advantage — not just in compliance, but in the trust they build with clients who increasingly care about how their data is handled.
